CCTV footage obtained by 7NEWS captured the incident which took place in September. The 37-year-old father can be seen raking stones on the side of his property when he is approached from behind by a stranger.

“My client was working, doing some general maintenance down the side of his property … when a man has approached his property, entered through his garage which was left open and approached my client,” Lawyer Nick Hart from Hart Law Group told 7NEWS.
The man then allegedly hit the homeowner, knocking him backwards, in an “unprovoked, vicious attack”.
The 42-year-old accused then allegedly threatened the homeowner, picking up a spade and chasing him out onto the street.
The homeowner says he was able to hold the man down until police arrived.

“My client had to subdue that man on his own until he could be properly restrained by emergency services,” Hart said.
“Had that man been successful in his first (alleged) assault, who knows what could have happened.”
The homeowner, whose family was inside at the time, sustained “significant injuries” and was treated by paramedics at the scene.
“It’s not uncommon for a garage door to be open, we should feel safe in our own homes,” Hart said.
The man was charged with trespassing and assault and is due to appear at Southport Courthouse on Friday.
